Prices to be included in interconnection agreements between Cable & Wireless (West Indies) Ltd and the following operators: Caribbean Cable Communications (CCC), Weblinks Ltd (Weblinks) and Wireless Ventures Anguilla Ltd (Digicel).

Brief Overview

“The Commission hereby approves the prices for mobile and fixed termination and for transit services in interconnection agreements to be as set out in paragraph 9 of this decision.” (Paragraph 35, page 7).

Brief Overview

An extension was granted to C&W to respond to CCC’s petition, this date was set for the 31st January, 2006 (Paragraph 42, page 7). C&W was however directed to provide the ‘ISDN PRI Service’ see paragraph 41, page 6.

Brief Overview

‘The interconnection agreement’ dated 30th November 2005 and ‘Supplemental Agreement’ dated 30th November 2005 were both approved, see paragraph 10, page 2.

Brief Overview

The Commission approved the ‘interconnection agreement’ dated 23rd November, 2005 and the ‘Variation Agreement’ dated 24th November, 2005 (Paragraph 9, page 2).

Proposed voice Service (‘Netspeak’).

Cable & Wireless (West Indies) Ltd proposed a new public voice service to be offered in Anguilla under the brand name ‘netspeak’.

Brief Overview

C&W was directed to file for approval of the Netspeak service packages, including the price and components for each package, see paragraph 162, page 36.

In the matter of revised prices for a service with the brand name ‘NetSpeak’ provided by Cable & Wireless (West Indies) Limited in Anguilla.

Brief Overview

The Commission directed C&W to file a quarterly report consisting of the number of subscribers to NetSpeak package as well as a breakdown of the specific service package starting on March 31st, 2007, see paragraph 47, page 12

A review of prices to be included in interconnection agreements between Cable & Wireless (West Indies) Ltd (C&W) and the following operators: Caribbean Cable Communications (CCC), Weblinks Ltd (Weblinks) and Wireless Ventures (Anguilla) Ltd (Digicel).

Brief Overview

Each Licensed service provider (C&W, CCC, Digicel and Weblinks) was directed to file on a confidential basis a schedule of minutes and revenues for the period January 2007 to April 2007 on or before 25th January, 2008 (see paragraph 74, page 17).

Each service provider was also directed to file on a confidential basis a monthly schedule for the period starting the first month of interconnection to month-end April 2007 (see paragraph 75, page17).

In the matter of a review of prices included in interconnection agreements between Cable & Wireless (West Indies) Ltd (C&W) and the following operators: Caribbean Cable Communications (CCC), Weblinks Ltd (Weblinks) and Wireless Ventures Anguilla Ltd (Digicel).

Brief Overview

All service providers were directed to amend part 2 of the tariff schedule in their respective interconnection agreements so as to reflect the prices approved and set out in Table 1 and file to the Commission for approval on or before 25th April, 2008 (paragraph 99 and 100, page 20).

All service providers were also directed to file with the Commission on a confidential basis current international termination rates charged to international operators or affiliated operators for terminating incoming international traffic on their domestic networks in Anguilla on or before April 28th, 2008 (paragraph 102, page 20-21)

Brief Overview

CCC was directed to file with the Commission the information referred to in their submission of 13th October 2008 on or before 1st February, 2009 (Paragraph 75, pg.16).

The Commission directed C&W to include average per month minutes in their next NetSpeak quarterly status reports. They were also directed to file on or before 1st February, 2009 a copy of their current business and/or technology migration plan(s) or to explain the absence thereof (para.76 &77, pg.16).

‘All Talk’ Service.

In the matter of a service with the brand name ‘All talk’ provided by Lime (Cable & Wireless, Anguilla Ltd).

 

Brief Overview

C&W was directed to file confirmation with the Commission that the ‘AllTalk’ service was withdrawn as a service offering within seven days of the decision. They were also directed to file confirmation with the Commission within thirty days of the decision that the ‘AllTalk’ service to current customers had been withdrawn, see para. 38, pg.10.

Licensed operators were invited to file with the Commission on or before 3rd April, 2009 their views on the establishment of a criteria to distinguish a ‘promotional’ service offering from a permanent one, see para. 39, pg.10.

Review & Rescinding of decision related to ‘All Talk’.

In the matter of an application from Lime (Cable & Wireless, Anguilla Ltd) for the review and rescinding of Commission decision PUC 2009-101 with regards to the service ‘All Talk’ provided by Lime.

Brief Overview

C&W (Lime) was directed to file with the Commission within thirty days of the decision date 28th May, 2009 confirmation that the ‘AllTalk’ service to current customers has been withdrawn, see para. 80, pg.15.

Brief Overview

Digicel was directed to file with the commission on or before 30th September, 2009, a list of prices charged to IDD calls from customers that employ Digicel fixed/mobile device, see para. 140, pg.24.

In the matter of a revision of the date effective for an adjustment in the mobile termination price included in the interconnection agreements between Cable & Wireless (West Indies) Limited (C&W) and the following operators: Caribbean Cable Communication (CCC), Weblinks Ltd (Weblinks) and Wireless Ventures (Anguilla) Ltd (Digicel).

Brief Overview

C&W, Digicel, CCC and Weblinks were directed to amend part 2 of the Tariff schedule in their respective domestic interconnection agreements to reflect a MTR of EC$0.30, effective 1st November, 2009 and file such amendment with the Commission by 23rd November, 2009 (para. 101-102, pg.21).

The commission will also commence a review of prices for interconnection on or before 1st July, 2012, see para.103, pg. 21 for more information.

Subject

Complaint by Weblinks regarding Lime’s wholesale & retail Pricing.

In the matter of a complaint from Weblinks dated 5th May, 2010 regarding Lime’s wholesale & retail pricing for international outgoing calling services and domestic interconnection services.

 

Brief Overview

Lime was directed to file with the Commission and Weblinks, a copy of a proposal for adjusting the outstanding amount for international wholesale service provided to Weblinks. This was to be done within 30 days of the decision.

Lime was also required to file a revised invoice which reflects amounts as described in paragraphs 193-196. This is to be done within 30 days of the decision with copies to be sent to the Commission as well as Weblinks.

The Commission will render a final decision on the amounts due for wholesale service and domestic interconnection charges within 30 days of receiving Weblink’s response to Lime’s proposal or within 90 days of receiving Lime’s proposal in the absence of a counterproposal from Weblinks.

The commission recommended various changes be made to the level of interconnection rates. The Commission stated that further comments, including the recommended interconnection prices and any other relevant matters should be filed on or before 30th April, 2012.
